Today, employment law is more important than ever. Unemployment remains high, training is expensive and time-consuming, incidental wage costs are exorbitant, and rules and regulations suffocate flexibility: all these factors need planning and a strategic approach. The situation is aggravated by complex new provisions that are expensive to comply with, such as those in the General Equal Treatment Act.

Today it is no longer enough to know the law on protection against dismissal and to survive its effects in court. What is important are the fundamental decisions:

  • Should the company join the national collective pay agreement or have its own company pay agreement?

  • If the law offers a variety of procedures, for example temporary work or short-time working, how can these be planned and organised?

  • How can employment contracts be drafted to satisfy the requirements of the courts and statute law but at the same time to guarantee flexibility?

  • What payment models attract qualified employees but can still be adapted as necessary in times of crisis?

  • Apart from employment contracts, are there other ways of organising work that are more attractive than employment contracts?

To cooperate effectively with the works council, you need to know the rules of the game.Conflicts slow processes down and prevent both innovation and flexibility. A conciliation board is no more than an emergency solution, not just because of the high costs it entails.

Finally, it is necessary to have a thorough understanding of the social security system, since employees are increasingly basing their decisions on this (for example with regard to partial retirement, the Riester pension, a termination agreement with periods of disqualification and suspension of unemployment benefit, job creation and qualification company) and expect the employer to provide information and well-thought-out programmes.
